Terms of Service

Applies to: The Apricot mobile application (the “App”).

These Terms of Service (“Terms”) are a binding agreement between you and Momentum Aksiyon Teknoloji Ltd. Şti. (“Apricot,” “we,” “us,” “our”), which operates the App under the Apricot brand. By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. The App is for adult caregivers of a baby, not for children.

2. What the App Is — and Isn't

Apricot is an AI-assisted newborn-care guide. It answers questions, helps you log care, and may look at photos you send. The App is not a medical device or diagnostic tool and does not provide medical advice, diagnosis, or treatment.

3. Not Medical Advice

Chat answers, photo comments, logs, and any “call your pediatrician” or similar language are for informational and self-care purposes only. They are not a diagnosis, prescription, or treatment plan. The assistant is not a doctor or licensed clinician. Always consult a qualified healthcare provider for your baby’s care. If you think your baby needs urgent or emergency care, contact a clinician or emergency services immediately. Never delay professional care because of something in the App.

4. AI-Generated Output

Answers are generated by automated systems and may be inaccurate, incomplete, or not suited to your baby. They are guidance, not guarantees. You are responsible for how you use the App and for seeking professional care when needed.

5. Your Account

You sign in with Apple, Google, or email and password. Keep credentials secure and accept responsibility for activity under your account. If you invite a co-parent, you are responsible for that invitation.

6. Subscriptions, Billing & Auto-Renewal

The App offers auto-renewable subscriptions that unlock premium features.

• Billing: purchases are processed by Apple In-App Purchase and charged to your Apple ID. We do not store your card number.
• Auto-renewal: the subscription renews at the end of each period unless you cancel at least 24 hours before it ends. Apple charges renewal within 24 hours prior to the end of the current period.
• Cancel: manage or cancel in your Apple ID (App Store) subscription settings. Deleting the App or your account does not cancel billing.
• Refunds: handled by Apple under App Store policies.

Apple Media Services / EULA terms also apply to App Store purchases.

7. Acceptable Use

You agree not to: upload photos of anyone without authority to do so; misuse the App; reverse-engineer, scrape, or interfere with our systems; use the App unlawfully; or bypass security or payment controls. Photos you send should be of your baby in a care context you intend to ask about.

8. Your Content

You retain ownership of logs, messages, and photos you provide. You grant us a limited license to process them solely to operate the App for you, as described in the Privacy Policy. We do not use your content to train OpenAI’s models, and we do not sell it.

9. Intellectual Property

The App and its technology are owned by us or our licensors. These Terms grant only a limited right to use the App.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY ANSWER IS ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms.

13. Changes

We may modify features and these Terms. We will post the revised Terms and update the Effective Date. Continued use after changes take effect is acceptance.

14. Termination

We may suspend or terminate access if you violate these Terms. You may stop using the App and delete your account at any time.

15. Governing Law

These Terms are governed by the laws applicable to Momentum Aksiyon Teknoloji Ltd. Şti., without regard to conflict-of-laws rules.
